Jammu and Kashmir was, from 1846 until 1952, a princely state of the British Empire in India. When the British left India, the Maharaja of Kashmir signed the Instrument of Accession joining the Dominion of India in return for military aid. Thus historically and politically Kashmir was a part of India and Pakistan was formed much later than Kashmir.
